Terms of Service

These terms govern your use of khojhome.co and any purchase you make from Khoj. By using this site or placing an order you agree to them. Please read them alongside our Shipping & Returns page and our Privacy Policy.

1. Who we are

Khoj is a home fragrance and personal care brand operating from British Columbia, Canada. In these terms, “we”, “us” and “our” mean Khoj; “you” means the person using the site or placing an order.

2. Using this site

You may use this site for lawful purposes only. You agree not to attempt to gain unauthorised access to the site, interfere with its operation, scrape it by automated means, or use it to transmit anything unlawful or harmful. We may suspend access to anyone who does.

You must be the age of majority in your province or territory, or have the consent of a parent or guardian, to place an order.

3. Products, descriptions and images

We describe our products as accurately as we can. Fragrance is subjective and natural materials vary slightly between batches, so scent may differ marginally from one bottle to the next. Colours may also appear differently on different screens. These variations are normal and are not faults.

Products are offered subject to availability. We may change or discontinue a product at any time.

4. Pricing and payment

All prices are shown in Canadian dollars and exclude applicable taxes, which are calculated at checkout. We may change prices at any time, but changes will not affect orders already accepted.

We take reasonable care to ensure prices are correct. If a product is listed at an obviously incorrect price because of a typographical or system error, we may cancel the order and refund you in full rather than supply at that price.

Payment is taken at checkout through Shopify Payments and the other providers shown at checkout. We do not store your full card details.

5. Orders

Your order is an offer to buy. A contract is formed only when we send you a shipping confirmation. We may decline or cancel an order — for example where an item is out of stock, where we cannot verify payment or delivery details, or where we suspect fraud — and will refund you in full if we do.

6. Shipping, returns and refunds

Delivery timescales, shipping rates, returns, cancellations and refunds are set out in full on our Shipping & Returns page, which forms part of these terms. In summary: orders leave us within one to two business days, we ship within Canada only, and unopened items may be returned within 30 days of delivery.

7. Safe use of our products

Our reed diffusers are for home fragrance only. They are not to be eaten or drunk. Keep them out of reach of children and pets, stand them on a protected surface away from heat, direct sunlight and open flame, and wash your hands after handling the reeds. If the liquid contacts skin, rinse with water; if it contacts eyes or is swallowed, seek medical advice. Spilled liquid can mark wood, painted, plastic and stone surfaces — wipe it up immediately. We are not responsible for damage caused by misuse or by failure to follow this guidance.

8. Accounts

If you create an account, you are responsible for the accuracy of the information you give us and for activity that takes place under your account. Tell us promptly if you believe your account has been used without your permission.

9. Marketing communications

If you join our mailing list we will send you occasional emails about new releases and the brand. You can unsubscribe at any time using the link in any email, or by contacting us.

10. Intellectual property

The Khoj name, logo, product names, copy, photography and site design are our property or used under licence, and are protected by copyright and trade mark law. You may not reproduce or use them commercially without our written permission.

11. Third party links

This site may link to sites we do not control. We are not responsible for their content, products or privacy practices.

12. Limitation of liability

Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot lawfully be limited, and nothing in them affects your statutory rights under applicable Canadian consumer protection law.

Subject to that, our total liability arising out of any order is limited to the amount you paid for that order, and we are not liable for indirect or consequential loss.

13. Changes to these terms

We may update these terms from time to time. The version published on this page at the moment you place an order is the version that applies to it.

14. Governing law

These terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply there, and the courts of British Columbia have exclusive jurisdiction.
